My name is Ruslan Petryshyn, I'm 20 years old International student from Ukraine (East Europe). I come to US for LEGAL summer work (Grocery Clerk). My company name is Pathmark - Grocery store, located in 5100 Wellington avenue, Ventnor, NJ 08406. When I been in Ukraine they wrote 8$ per hour, minimum 30 hour, also they promise me 40 hours. But they didn't do that. All time I receive around 24 -26 hours, My average hour is 24 for all summer, I need to pay for my room, food, transport from my home to work... I was trying to talk with manager Lou Panico, He promise me 38 hour, but just promise, He don't do that. Other students have 40 - 36 - 37 hour. Another work people in that store ask me do you work part time? But I must work Full time. I don't know what to do. I start to sleep badly, can't concentrate I'm really don't know..., who can help me. I think it isn't fair! I think America free country, where honest law-abiding. Please Help me! America is free country which means that they can hire who they want and how many hours they want you to work... If your employer finds out that you posted this on the internet with your full name you will probably be fired so if I were you I would remove this immediately.

First, America is NOT such a free country, but it IS a country where people have many opportunities legally to fight for freedom. Oftentimes freedom is not given to you on a plate; you have to fight for your rights because there are a lot of bad people around in positions of power. Contact a lawyer. There is a lot about life that isn't fair, but complaining will not get you anywhere. In fact complaining is a sure way to lose your job. In New Jersey, employees are presumed to be "at will." At-will employees may be terminated for any reason, so long as it's not illegal. At-will employment is a doctrine of American law that defines an employment relationship in which either party can break the relationship with no liability, provided there was no express contract for a definite term governing the employment relationship and that the employer does not belong to a collective bargain (i.e., has not recognized a union). Under this legal doctrine: “any hiring is presumed to be "at will"; that is, the employer is free to discharge individuals "for good cause, or bad cause, or no cause at all," and the employee is equally free to quit, strike, or otherwise cease work. In New Jersey, if an employer shows express proof that an employee is employed at-will, even an implied contract will not overcome the presumption of at-will employment. You are lucky to be working 24-26 hours a week. There are hundreds of thousands of Americans struggling to find a job. Your manager cannot give you more hours just because you need more money. The store is most likely having to cut back on employees and hours just like other businesses. You are free to look for a job somewhere else with more hours, however finding a full time job in this economy will be very difficult. I would not mention discrimination or you run the risk of losing your job.

You have the freedom to go work somewhere else for 40 hours or just work somewhere else for an additional 16.

If you have a copy of the correspondence where the store " guaranteed" you a minimum of 30 hours per week at $8 dollars per hour, you could tell the manager that he is in violation of the contract and that he owes you for the back pay difference(30 hrs- 24hrs= 6 hrs per week). You could force payment through the labor board if necessary, however doing so would probably end your employment unless the contract also guaranteed a specific time period of employment.

Why would you put your full name address of the company your work for and manager's name on the internet for the whole world to see? Whether or not you are being discriminated against, which I don't think you are, this is totally unprofessional. If your employer saw this it would be cause for termination. Haven't you heard all the stories of people who lose their jobs for posting things on their facebook pages or other places on the internet? There are people all over the country who would kill for those 24-26 hours, maybe they are trying to work around your school schedule. Maybe they just don't have the money to give everybody 40 hrs a week. There are a lot of reasons you could be getting fewer hours than you thought most likely the horrible economy and the nature of working in grocery.
